The FDA recognizes CBD for the potential opportunities that cannabis or any products that are cannabis derived can provide. The FDA is aware that there are companies that use and market cannabis and cannabis-derived compounds in ways that violate the FDA and the Federal Food, Drug and Cosmetic Act. This may ultimately have unsafe results for those who use them putting the consumer’s health and safety at risk.

The new bill that is on the horizon will allow hemp-derived CBD products to be lawfully marketed as a dietary supplement. The passing of the 2018 Farm Bill was just one of the steps that CBD legalization accomplished. The next big step is for the (FDA) Food and Drug Administration, to process regulations that would allow businesses to sell the product in the nutritional supplement section of a store. However, the former commissioner of the FDA states that without congressional action, this could take years to be achieved.

This proposed bill could help to resolve this dilemma. It would amend the current FDA and Cosmetic Act to include CBD with an understanding that it is can be used for dietary supplements. The bill was filed by Collin Peterson (D-MN). His hope is that this bill will allow the FDA to regulate the CBD produced from hemp as a dietary supplement and that this action will cement the forward path for the hemp-derived products. This bill has been referred to as the Agriculture and Energy and Commerce Committees.
